ORDER BELOW EXH1
Read application which is supported by an affidavit of the
applicant. Perused the record & proceeding. BMC has given say that
applicant has submitted documents and it is left for the Court to
decide the matter. Applicant submitted photocopy of Medical
certificate of Cause of Death, death report, statement of death
registry of deceased viz. REHMATULLAH ZAKAULLAH SHAH.
Application is also supported with the affidavit of witness viz.
Hamidullah Shah. Admittedly, the date of death of applicant's
husband viz. REHMATULLAH ZAKAULLAH SHAH 07.12.2019. In
the circumstances, I am satisfied to grant this application u/s. 13 (3)
of R.D.D. Act. Hence, I proceed to pass the following order:
ORDER
1. Application is allowed.
2. B.M.C., Mumbai is hereby directed to register the date of
death of husband of the applicant viz. REHMATULLAH
ZAKAULLAH SHAH as 07.12.2019.
3. Proceeding is closed.
