ORDER BELOW APPLICATION FOR RENEWAL OF PASSPORT
Heard learned Advocate for the applicant as well as learned APP for
prosecution.
2. Applicant Mr.Bablu Girdhar Shah, Adult, r/o Malad(W), Mumbai, made
application seeking permission to renew his passport No.K9259524 for the period of
ten years.
3. Criminal case No.1797/PW/2024 for offence u/secs.354, 323, 509, 504,
427, 34 of IPC, arising out of C.R.no.270/2023 registered at Malwani police station, is
pending against the applicant for trial in this court. The above noted travel document
obtained by him is due for renewal on 19/02/2023 which period is already expired.
4. In view of judgment of the Hon'ble Bombay High Court in case of
Roshan
Lawrence Menezes v/s. Union of India & Ors., dated 7th August 2020, in Writ Petition
(lodging) no.699/2020, passport may be renewed and may be ordered to be issued
renewable after period of ten years. Considering the prayer, application deserves to be
allowed, as under :
ORDER
1) The court has “No objection” for
consideration of renewal of passport held by
applicant Mr.Bablu Girdhar Shah, Adult, r/o
Malad(W), Mumbai, for a period of ten years,
by considering requisite criteria.
2) The applicant is directed to file a copy of
renewed passport in the concerned
proceeding pending in the court.
3) Application is disposed of in above terms.
