1. This application moved by accused Munawar Anwar Abdul
Hamid Shaikh for bail by contending that he is falsely implicated into the
crime. According to accused, he has no connection with the crime, however,
complainant with oblique motive lodged false complaint against him. It is
contention of the accused that considering his age, he may be released on
bail. Learned A.P.P. opposed the application with the say that investigation is
going on and accused may tamper the witnesses. I.O. has also raised the
objection to grant the bail application.
2. It appears from the record that offence is serious in nature.
Further, it appears that modus operandi of the accused in commission of the
crime of theft by cheating informant is very dangerous to public at large.
Further, accused has delivered the possession of one gold lagad to the value of
Rs.65,000/- but the stolen property of golden ring and golden chain is valued
of Rs.1,45,000/- and therefore, remaining part of the gold stolen property is
yet to be recovered. Further, as per the say of the I.O., if accused is released
on bail then he may pressurized informant and witnesses and interfere the
investigation. The prosecution also raised the objection to release accused on
the ground that he may abscond. Hence, under such fact and circumstances, it
appears that presence of accused cannot be secured in future. Further,
investigation is still in process. Therefore, it will not be just and proper to
release the accused on bail. Hence, following order :-
ORDER
1. The Bail Application is hereby rejected.
