849/PW/2020, TILAKNAGAR POLICE STATION.
1. This application moved by the applicant Nilofar Imran Khan for
seeking no objection to obtain/issuance of passport. Applicant has
also filed her supporting affidavit.
2. The Ld. A.P.P. filed the say and strongly objected this application on
the grounds that the accused has committed serious offence and
offence against women. Granting permission to issue a passport at
this stage may face a risk of occurred absconding or tampering with
the evidence or witnesses and will facilitate international level and
there is no assurance that accused will return or remain present on
trial. The possibility of fleeing from justice cannot be ruled out.
3. Perused the charge sheet. The accused is charge-sheeted for the
offences punishable 325, 354, 509, 323 r/w. 34 of the Indian Penal
Code. The charge-sheet had been filed in the year of 2020 after
detail investigation.
4. Considering the facts and circumstances of the case along with say
filed by learned A.P.P. there are no any circumstances which will be
made out in respect of accused which may create a legitimate doubt
that she will abscond. In the result, the application deserves to be
allowed and no objection shall be granted for issuing/obtaining
passport to accused for going abroad. Hence, I pass the following
order :
-: O R D E R :-
1) Application is allowed.
2) Permission is granted to issue passport to accused Nilofar
Imran Khan as per the applicable law and rules framed
thereunder.
3) Accused Nilofar Imran Khan shall remain present in the
Court during the course of trial.
4) The accused should obtain prior permission of this court
before going abroad for any purpose.
