ORDER BELOW EXH-1
Heard the complainant in person. Perused the allegations
with reference to the documents filed on record.
2. It can be seen from the record that it is matter relating to
affairs of Co-operative Housing Society. Indeed, according to the
complainant the society is also made accused. It is alleged that the
society and members thereof i.e. accused nos. 2 to 7 committed some
misdeeds in the affairs of the society. They are prayed to be tried for
the offences punishable under sections 166, 406, 409, 420 etc of IPC
alongwith section 83 of Maharashtra Co-operative Societies Act.
3. Considering the nature of allegations and more particularly
the allegations, the cognizance of which can only be taken by
appropriate forum like Co-operative court, I do not find it proper to
issue process. Hence, the following order is passed:-
ORDER
1. Issuance of process is postponed.
2. The concerned police shall make inquiry in the allegations
made in the complaint and shall submit its report under section 202 of
Cr.P.C.
