Pdf Text: ORDER BELOW BAIL APPLICATION NO. 1705/BA/2023 IN CONNECTION WITH
CR NO. 266/2015 OF TILAK NAGAR POLICE STATION
1) Accused Smt. Karima Mujib Shah has moved this
application for praying to release himself on bail under section 437
of the Cr.P.C.
2) Read the application and say filed below it by A.P.P. I. O.
failed to file say though reasonable time is granted.
3) Heard the Ld. Advocate of the accused and Ld. A.P.P.
4) The police leveled charges against the accused persons of
the offence punishable under Section 309 of the Indian Penal Code
and section 142 of Maharashtra Police Act. Ld. A.P.P. submitted her
say on this application that the accused has been arrested on
execution of warrant as the accused failed to appear before this court
so many dates. If the accused released on bail there is every
possibility she may abscond and evade the judicial proceeding.
5) It is true that accused is brought on execution of NBW.
However, considering the nature of offence and the reason made out
by the accused and the fact that another accused is already released
on bail after cancellation of NBW, this accused is also entitled for the
bail to afford one more opportunity. In the result I proceed to pass
following order.
-: O R D E R :-
1) This application is hereby allowed.
2) Accused Smt. Karima Mujib Shah be released on bail for
executing P.R. Bond of Rs. 15,000/- and surety for the like
amount to accused subject to condition that, accused
should furnish his residence proof and contact number.
