Pdf Text: ORDER BELOW BAIL APPLICATION NO. 1061/BA/2024 IN CONNECTION WITH
C. C. NO. 170/PW/2018 OF TILAK NAGAR POLICE STATION
1. Accused Jitendar @ Jitu Walmiki has moved this application for
praying to release himself on bail under section 437 of the Cr.P.C.
2. Read the application. Ld. APP failed to file say though reasonable
time is granted.
3. Heard the Ld. Advocate of the accused.
4. The police leveled charges against the accused persons of the
offence punishable under Section 394, 506(ii) r/w. 34 of the I.P.C.
and section 37(1)(a) r/w. 135 of M. P. Act. Ld. A.P.P. submitted that
the accused is not a law abiding citizen and this court issued NBW
against him after due diligence the police could not arrest him. If
the accused released on bail there is highly possibility of abscond
and it would be mockery of police machinery as the police arrested
the present accused by huge efforts. Due to absence of accused, this
matter could not proceed further. At present the accused is in
custody, so the matter can be proceeded expedite.
5. It is true that accused is brought on execution of NBW. However,
considering the nature of offence and the reason made out by the
accused and the fact that another accused is already released on bail
after cancellation of NBW, this accused is also entitled for the bail to
afford one more opportunity. In the result I proceed to pass
following order.
-: O R D E R :-
1) This application is hereby allowed.
2) Accused Jitendar @ Jitu Dharmpal Walmiki be released on bail
for executing P.R. Bond of Rs. 15,000/- and surety for the like
amount to accused subject to condition that, accused should
furnish his residence proof and contact number.
3) Accused to pay penalty of Rs.2,000/- in lieu of previous bond.
