ORDER BELOW EXH.1 IN C.C. NO. 472/N/2023
This is an application moved by applicant Tanishi Aashish
Ravani for grant of permission for renewal the passport. It is contention
of the applicant that, offence is registered against her and same is
chagesheeted vide C.C. No. 1162/PS/2016 by Pantnagar Police Station.
It is contention of applicant that, she has not renewed this passport.
However, it is also interlia contended that, she will not leave the
jurisdiction of the Pantnagar Police Station without permission of the
Court. Ultimately, applicant praying for granted of permission for
renewal of passport.
2] Say of Prosecution and Investigating Officer called by this
Court. Prosecution opposed the application by showing apprehension
that accused/applicant will abscond if permission is granted. Similar is
the say Investigating Officer.
3] Accused/applicant submitted that, she will ready to abide
all the conditions to imposed by this Court. It is further contended by
the accused, she is permanent residence of Mumbai and not likely to
abscond.
4] Considering the submissions before the Court, and
undertaking given by the accused/applicant that, she would not go
abroad in near future without permission of the Court. It is
unwarranted to deny the permission which is meant for renewal of
passport only. No doubt, such permission would not mean permission
to go abroad. Hence, by allowing application, I proceed to pass
following order :

ORDER
A] Application is allowed.
B] Permission is granted accused/applicant Tanishi Aashish Ravani
to apply for renewal of passport for the limited of five years to the
Competent Authority as per rules.
C] This order can not be treated as a permission to go abroad, rather
this order is limited for renewal of passport.
