ORDER BELOW EXH.1 IN C.C. NO. 434/N/2022
1] This is an application for return of property i.e., Toyota
Etios VD M Bearing No. MH10BM6195, value approximately Rs.
4,50,000/, seized by Pantnagar Police Station in C.R. No. 634 of 2022.
2] This Court called to say of all the interested parties in the
proceeding. In that regard, so far as say of I.O., complainant and
accused are concerned, they have no objection to release the vehicle in
favour of applicant. The Learned A.P.P. objected the application by
propounding apprehension that, applicant may change the nature of
property. It is pertinent to note that, for that purpose strict condition
can be imposed against the applicant. No substance would be suffice
to pile the vehicle in the police station, as it is unwarranted.
3] The applicant is the registered owner of the vehicle and he
has submitted the relevant documents to that effect. The application is
supported by affidavit. Applicant is ready to abide all conditions
imposed by the Court. No purpose would be served in keeping the
property in police station. Considering the nature of property and
submissions, I pass the following order :
ORDER
A] Application is allowed.
B] The interim custody of muddemal property i.e., Toyota Etios VD
M Bearing No. MH10BM6195, is granted in favour of applicant
Majahid Mustak Qureshi.

C] Applicant to execute indemnity bond of Rs. 10,00,000/ (Rs. Ten
Lakhs Only).
D] Sr. P.I. of Pantnagar Police Station is directed to hand over the
muddemal property after preparing panchanama and after taking
photographs of said muddemal property. Sr. P.I. of Pantnagar
Police Station is directed to produce panchanama and
photographs with the case papers.
E] Applicant is directed not to sell, transfer or in any manner
alienate the muddemal property or change its nature without
permission of the Court till disposal of the case.
F] Applicant to produce the said vehicle whenever directed by the
Court at the time of trial.
