POLICE STATION
1) The accused has moved this application for praying to
release himself on bail under section 437 of the Cr.P.C.
2) Read the application and say filed by Investigation Officer
& APP.
3) Heard the learned Advocate of the accused and APP.
4) On reading of first information report and remand report
of accused, it seen that accused has committed an offence punishable
under section 3 of the Passport (Entry into India) Act, 1920, section 6
of the Passport (Entry into India) Act, 1950 and Rules 3 & 14 of the
Foreigner Order 1948. As per the prosecution story, the accused
entered into India without any valid passport and residing therein by
concealing his identity. The alleged offence is so serious. There are
chances of absconding of the accused and he will not remain present
for trial, if accused is released on bail. In the case the accused is
released, it would amount to giving permission to the accused to stay
in India without valid VISA or passport. Hence, I hold that this is not
fit case to grant bail to the accused. In the result, this application is
liable to be rejected and thereby, following order is passed.

1) This application is hereby rejected.
