ORDER ON APPLICATION DTD. 30.09.2020 :
1] Read application and say of I.O. Applicant submitted this
application u/s.457 of Cr.P.C. for return of property i.e. Bajaj Auto rickshaw
bearing No.MH03BY8000.
2] I have carefully gone through the documentary evidence and
found that applicant is the owner of the vehicle seized by the police station
Parksite and said vehicle came to be seized in C.R.No.515/2020 of P.S
Parksite. Applicant is the owner of said vehicle. Applicant has furnished the
affidavit alongwith xerox copy of R.C.Book, fitness certificate, driving
licence, insurance, and copy of aadhar card. Parksite Police Station I.O.
has no objection for handing over the Auto rickshaw to the applicant. It
would not be proper to keep the muddemal property in police station. It is
a rule to return the property and rejection is an exception.
Hence, application is hereby allowed on following terms and
conditions.
ORDER
1] Applicant Mr. Munir Amir Sayyed is hereby directed to execute
indemnity bond of Rs.50,000/(Rs.Fifty Thousand only).
2] He should not sell, mortgage or dispose off the vehicle in any
manner without prior permission of the court.
