Pdf Text: ORDER BELOW IN CRIMINAL CASE NO. 36/N/2025 IN C. C.
849/PW/2020 CR NO. 459/2019, TILAKNAGAR POLICE STATION.
1. This application moved by the accused Imran Moosa Khan for
seeking no objection to issue/renewal the passport. The accused has
also filed his supporting affidavit.
2. The Ld. A.P.P. filed the say and strongly objected this application on
the grounds that the accused committed serious offence and if this
application is allowed then the applicant/accused will go to abroad
and will abscond. Further due to his absence this matter will not
proceed further.
3. Perused the charge sheet. The accused persons are charge-sheeted
for the offences punishable u/sec. 325, 354, 509 & 323 of Indian
Penal Code. The charge-sheet had been filed in the year of 2020
after detail investigation. So there is no any question or possibility
about tampering the evidence by the accused.
4. Considering the facts and circumstances of the case along with say
filed by learned A.P.P., there are no any circumstances which will be
made out in respect of absconding of the accused, because he
wanted to renew passport for traveling abroad. In the result, the
application deserves to be allowed. Hence, I pass the following
order :
-: O R D E R :-
1) Application is allowed.
2) Permission is granted to renew the passport No. K-
4547819 to the accused Mr. Imran Moosa Khan as per
the applicable law and rules framed thereunder.
3) The accused Mr. Imran Moosa Khan shall remain
present in the Court during the course of trial.
4) The accused should obtain prior permission of this
court before going abroad for any purpose.
