NO 1206/PW/2022.
1) This application moved by the accused Mr. Sandeep
Balkrishna Gawde for seeking no objection to renew the passport. The
accused has also filed his supporting affidavit.
2) Ld. A.P.P. objected this application on the grounds that if
the accused is allowed may shift permanently outside India and may
not be available for trial.
3) Perused the charge sheet. The accused persons are charge-
sheeted for the offences punishable u/sec. 141, 143, 149, 427 of Indian
Penal Code and section 37 (ii) r/w. 135 of the Maharashtra Police Act.
The charge-sheet had been filed in the year of 2022 after detail
investigation. So there is no any question or possibility about tampering
the evidence by the accused.
4) Considering the facts and circumstances of the case along
with say filed by learned A.P.P., there are no any circumstances which
will be made out in respect of absconding of the accused, because he
wanted to renew passport for traveling abroad. In the result, the
application deserves to be allowed. Hence, I pass the following order :
-: O R D E R :-
1) Application is allowed.
2) Permission is granted to renew the passport No.
K9254008 to the accused Mr. Sandeep Balkrishna
Gawde as per the applicable law and rules framed
thereunder.
3) The accused Mr. Sandeep Balkrishna Gawde shall
remain present in the Court during the course of
trial.
4) The accused should obtain prior permission of this
court before going abroad for any purpose.
