This is an application for permission to leave to abroad.
The application, in brief, is as under :-
02. The applicant is charged with the offence punishable under S. 326 of
the IPC. The applicant is willing to visit Dubai from 20-05-2024 to 30-05-2024.
Hence, the applicant prayed for permission to leave abroad i.e at Dubai.
03. Ld. APP objected the application by filing say that the offence is of
serious nature and there is no possibility of returning of the accused, if is
allowed to go to other countries.
04. In light of the application, it is not disputed that the accused is
charged with the offence punishable under S.326 of the IPC. It appears from
travel summary that the accused is traveling to Dubai from dated 20-05-2024 to
30-05-2024 and name of the applicant is mentioned as a ticket holder. In
circumstances, permission to leave abroad cannot be rejected on sole ground
of pending criminal case. At the most, his presence could be tried to be secured
by way of conditional order. Hence, the order :-
ORDER
(01) The application to leave for abroad i.e. at Dubai is allowed subject to
condition that, the applicant shall remain present before the Court or before
I.O. on direction by this Court or the Hon'ble Superior Courts, as and when
called out, in spite of continuance of leave for given period.
(02) Amount of Rs. 15,000/- be deposited towards security with indemnity
bond of Rs.1,00,000/-.
(03) This application be put on record of C.C. No. 173/PW/2019.
