This is an application for permission to leave to abroad.
The application, in brief, is as under :-
02. The applicant are charged with the offence punishable under
S. 498A, 406 of the IPC. The applicant are willing to visit Saudi Arabia
from 10.04.2024 to 31.05.2024. Hence, the applicants prayed for
permission to leave abroad i.e at Saudi Arabia.
03. In light of the application, charge sheet shows that the accused
are charged with the offence punishable under S.498A, 406 of the IPC.
It appears from plane tickets that the accused are traveling to Saudi
Arabia from dated 12.04.2024 to 01.06.2024 and name of the
applicants is mentioned as a ticket holders. In circumstances,
permission to leave abroad cannot be rejected on sole ground of
pending criminal case. At the most, their presence could be tried to be
secured by way of conditional order. Hence, the order :-
ORDER
The application to leave for abroad i.e. at Saudi Arabia is allowed
subject to conditions that :-
(a) The applicants shall remain present before the Court or before I.O.
on direction by this Court or the Hon'ble Superior Courts, as and when
called out, in spite of continuance of leave for given period,
(b) The applicants shall file particulars about address of their stay at
Saudi Arabia and their contact numbers.
(c) Cash security of Rs.15,000/- in each, be deposited by the
accused/applicants till their return to India.
