Read application and reply of Ld. APP. Heard both Ld.
Counsel at length.
The accused has filed application for enlarging him on
bail. He has contended that he is falsely implicated and is ready to
abide with any condition and with remain present on each date
before court.
APP have strongly objected on ground that offence
levelled are serious in nature.
Perused case file. The charge sheet is filed under Section
420, 465, 468, 471 read with 34 of Indian Penal Code. Today
Accused was brought before court in execution of non bailable
warrant and remanded remanded to the magesterial custody.
Perused the case file. Record shows that matter is Part
Heard and since 2017 accused was absent hence, warrant issued.
Previously accused was on PR bond and cash surety of
Rs. 25,000/- This accused has executed PR bond on 19/11/2008
and also deposited cash bail . As NBW is executed hence PR bond
and cash bail stands forfeited. Now accused is praying for the bail.
The matter is Part heard. The accused has attached the copies about
his medical treatment. Hence, no purpose to put accused behind
bar . Hence, Imposition of conditions will suffice the purpose. Hence,
applicant is entitle to enlarge on bail. But, he has jumped the
condition of PR bond and cash bond which is executed on
19/11/2008. Hence, the amount of cash bail Rs.25,000/- deposited
on 19/11/2008 is required to be forfeited to State. Accordingly, the
present application deserves to be allowed with conditions.

Accordingly, order :
ORDER
1) Application is allowed.
2) Accused is released on PR & SB of Rs.25,000/- on condition
that
a) He shall attend each and every date fixed by with Court
without fail.
b) His cash bail amount of Rs.25,000 deposited on 19/11/2008
be forfeited and it be credited to the state.
c) Provisional Cash bail of Rs.25,000/- is granted till next date.
d) Accused shall furnish address proof of himself and his two
relatives. sd/-
