ORDER BELOW BAIL APPLICATION NO. 1009/BA/2026
Read the application and say. Heard Ld. Advocate for the
accused and Ld. APP. The Ld. Counsel of accused submitted that, the accused
is in M.C.R. The accused had no role in the offence. The accused is falsely
implicated. The accused is ready to follow all the terms and conditions.
Hence, the accused be released on bail.
2) Ld. A.P.P resisted the present application on the grounds that
offence is serious in nature. The accused is involved in the offence. Hence,
prayed for rejection of bail application.
3) Perused the remand papers. It appears that, accused was
arrested for the offence punishable under Sec.188, 269 of IPC. The
chargesheet is already filed. The custody of accused is not required for
further investigation. No purpose would be served by keeping the accused
behind bar. The accused is ready to attend the Court on each and every day
and follow all the terms and conditions. The offence is not punishable with
death or life imprisonment. Hence, the accused is entitled for bail. Hence, I
pass following order :-
ORDER
(1) The application is allowed.
(2) The accused be released on furnishing P.B. and S.B. of Rs. 5,000/-
(Rs. Five Thousand Only) or cash bail of Rs.5,000/- (Five
Thousand Only) with P. R. bond of Rs.5,000/- in Crime
No.450/2021 of R.C.F. Police Station for the offence punishable
under sec.188, 269 of IPC.
(3) The bail application is disposed-off accordingly.
