Order Details: Bail Order Pdf Text: CRIME NO. 515/2026 OF MANKHURD POLICE STATION, MUMBAI. ORDER BELOW BAIL APPLICATION NO. 792/BA/2026 1) Read the application and say. Heard Ld. Advocate for the accused and Ld. APP. The Ld. Counsel of accused submitted that, the accused is in M.C.R. The custody of accused is not required for further investigation. The accused is falsely implicated in the case. Bail is rule and jail is exception. The accused is ready to attend the Court on each and every date. Hence, accused be released on bail. 2) Ld. A.P.P. and I.O. resisted the present application on the grounds that the accused is involved in the offence. Accused is habitual offender and committed several offence of similar nature. Hence, prayed for rejection of bail application. 3) Perused the remand papers. It appears that, accused is arrested for the offence punishable under Sec. 303(2), 311(4) of BNS. The FIR shows that, the informant had lodged the report against the unknown person for committing cheating and theft. The accused was arrested during the investigation and some of the stolen property has been recovered from him. During investigation the accused has admitted that he has committed the offence along with other accused. Several cases were registered against the accused in Kalyan Police Station, Mahatma Phule Police Station and Devendra Nagar Police Station. Therefore, it is clear that accused is habitual offender. Therefore, if the accused released on bail, there is every possibility that he may again commit the similar type of offence in near future. The investigation is at initial stage. The other accused is absconding. Therefore, at this stage the accused is not entitled for bail. Hence, I pass following order :- ORDER (1) The application is hereby rejected.
