Order below Exh-1 in MA No. 2815/M/2025.
This is an application filed by the applicant Chetan
Rajendra Gupta for return of property i.e. 30 Gram gold in solid state.
2] Perused the say filed by Ld. APP and investigating officer.
Ld. APP prayed to pass necessary orders. Investigating Officer has no
objection for returning the property to the applicant.
3] As per the contention of the applicant he is the owner of
the said property. He has contented that, after due inspection he has
identified the said property. Now it is informed that, the said gold ingot
have been seized by the Chunabhatti Police in Crime No. 556/2025. As
per the contention of applicant he is entitled to the custody of the same
being the rightful possessor. In support of present application applicant
of above mentioned crime has filed affidavit, copy of F.I.R. copy of tax
invoice of a ornament and copy of Aadhar card.
4] Further, except the present applicant no one has claimed
right over the said property. In such circumstances, police machinery
will be unnecessarily burdened to look after the said gold ingot. In such
a situation, it is desirable to hand-over the gold ingot to the applicant
on his executing indemnity bond as he appears to be the rightful
possessor of the said gold ingot. Accordingly, I proceed to pass following
order and the application is hereby granted on following terms and
conditions :-

1] The muddemal i.e. Gold Ingot in CR. No.556/2025 registered
with Chunabhatti Police Station be handed over to the applicant on his
executing the bond of Rs. 4,50,000/- (Rs. Four Lakh Fifty Thousand
Only) on the following terms and conditions.
a) The applicant shall produce the aforesaid muddemal property
in the Court whenever ordered.
b) That the applicant shall not transfer, alienate, or make any
third party interest in any manner in the abovesaid muddemal
till final decision of the case.
c) The I.O shall take photographs of the said gold ingot at the
cost of the applicant and prepare handing over panchanama
and file the same in the case papers.
2] Issue letter accordingly to the police station concerned.
