ORDER BELOW BAIL APPLICATION
1] By this application, applicant/accused is seeking his
release on bail. It is contended that the accused is arrested for
offence punishable under Section 305(a) of BNS. He is in MCR. He is
falsely implicated in the alleged offence. He is permanent resident of
Mumbai. The case is triable by this court. He is ready to furnish bail
and ready to abide by the conditions which court may impose. He is
earning member of his family. He is seeking grant of application.
2] Called the say of I.O. and learned APP. They opposed the
application.
3] I have gone through the FIR and remand report. Heard.
It can be seen that the present applicant/accused is came to be
arrested in same kind of offences, in different CR, by taking custody
of the accused from one offence to another. All are offences of theft.
However, only because more mobile phones are recovered than that
of the stolen property in one of the offence, does not mean that these
mobile phones are stolen property in each and every CR, in which the
accused is taken in custody. At present the accused is in MCR in all
five CRs and even stolen property is not recovered in rest of the
cases. Therefore, in the circumstances merely keeping the accused
behind the bars would not be useful for further investigation.
Therefore, accused is entitled to be released on bail. Hence, I pass
following order.

ORDER
1.
The accused be released on P. B and S.B/cash surety of
Rs.15,000/- (Rs. Fifteen thousand only/-), if not
required in any other case.
2. He shall not tamper prosecution evidence.
3. He shall produce his identity proof and residential
proof of himself and two blood relatives.
