Order below Exh-1 in Case No. 828/Misc./2026
This is an application filed by the applicant Raju Kunjayya
Shetty for return of property i.e. One Narzo Company Mobile Phone,
One Amplifier of Onbon Company, Two mikes of NYUHF200 company,
five speakers of V2VMX, a Red Colour Drum Set of Gladnick Company, a
Amplifier with their set of Aerons India Company and cash of Rs.
4,250/-.
2. Perused the say filed by the investigating officer and Ld.
APP. I.O. has submitted that, during the panchnama he has seized One
Narzo Company Mobile Phone, One Amplifier of Onbon Company, Two
mikes of NYUHF200 company, five speakers of V2VMX, a Red Colour
Drum Set of Gladnick Company, a Amplifier with their set of Aerons
India Company and he has no objection for returning the said property
to the applicant. Ld. APP has prayed to pass appropriate order.
3. As per the contention of the applicant he is the owner of
the said property. He has contented that, after due inspection he has
identified the said property. Now it is informed that, the said muddemal
have been seized by the Chunabhatti Police in Crime No. 449/2026. As
per the contention of applicant he is entitled to the custody of the same
being the rightful possessor.
4. Further, except the present applicant none has claimed
right over the said articles. In such circumstances, if the said articles are
kept lying in the police station it will definitely decrease the value of the
property. Also police machinery will be unnecessarily burdened to look
after the said articles. In such a situation, it is desirable to hand-over the
said articles to the applicant on his executing indemnity bond as he

appears to be the rightful possessor of the said muddemal property.
Accordingly, I proceed to pass following order and the application is
hereby granted on following terms and conditions :-
O R D E R
1. The muddemal i.e. One Narzo Company Mobile Phone, One
Amplifier of Onbon Company, Two mikes of NYUHF200 company,
five speakers of V2VMX, a Red Colour Drum Set of Gladnick
Company, a Amplifier with their set of Aerons India Company in
CR. No. 449/2026 registered with Chunabhatti Police Station be
handed over to the applicant on his executing the bond of
Rs.55,000/- (Rs. Fifty Five Thousand Only) on the following
terms and conditions.
a. The applicant shall produce the aforesaid muddemal property in
the Court whenever ordered.
b. That the applicant shall not transfer, alienate, or make any third
party interest in any manner in the abovesaid muddemal till final
decision of the case.
c. The IO shall take photographs of the said articles at the cost of
the applicant and prepare handing over panchanama and file the
same in the case papers.
2. Issue letter accordingly to the police station concerned.
