ORDER BELOW BAIL APPLICATION NO. 1176/BA/2025
1) Read the applicant and say. Heard Ld. Advocate for the accused and Ld.
APP. The Ld. Counsel of accused submitted that, the accused No.1 to 3 are in
M.C.R. The accused were falsely implicated in the case. Bail is a rule and jail
is an exception. The accused will co-operate with the investigation as and
when necessary. Hence, prayed for bail.
2) Ld. A.P.P. resisted the present application on the grounds that offence is
serious in nature. There is prima facie evidence against all the accused. The
accused may abscond and delay the trial. Thus, prayed for rejection of bail
application.
3) Perused the remand papers. It appears that, accused were charge-
sheeted for the offence punishable under Sec.75(2), 79, 351(1), 352, 3(5) of
BNS. All accused are in M.C.R. The charge-sheet shows that the accused were
granted anticipatory bail by Hon’ble Sessions Court, Gr. Bombay in ABA
No.1567/2024. The custody of all accused are not required for the
investigation purpose. Hence, no purpose will be served by keeping the
accused behind the bar. Hence, I pass following order :
ORDER
(1) The application is allowed.
(2) The accused No. 1 to 3 be released on furnishing P.B. and S.B. of
Rs. 15,000/- each (Rs. Fifteen Thousand Only) or cash bail of
Rs.10,000/- each with P. R. bond of Rs. 15,000/- each in Crime No.
309/2024 for the offence punishable under Sec.75(2), 79, 351(1),
352, 3(5) of BNS
(3) Bail Application is disposed of accordingly.
