ORDER BELOW BAIL APPLICATION
1] By this application, accused namely Ravi Chaman
Chauhan and Shahalam Shamshad Ahmed @ Salman are seeking
their release on bail. It is contended that accused are innocent and
falsely implicated in the offence. Accused are permanent resident of
Mumbai. They will not tamper with prosecution evidence. They are
is ready to abide with conditions which Court may impose. They are
seeking grant of application.
2] Called say of I.O. and APP. They opposed the application.
3] Heard both sides. I have gone through the FIR and
remand applications. It would show that the stolen property i.e.
mobile handset is recovered. Since more mobile handsets are
recovered, the accused is transferred to another offence. Therefore,
considering all above aspects, no good purpose would serve by
keeping the applicant/accused behind the bar. Therefore, I am
inclined to allow the application. Hence, I pass following order.
ORDER
1.
The accused namely, Ravi Chaman Chauhan and Shahalam
Shamshad Ahmed @ Salman be released on P. B and
S.B./cash security of Rs.15,000/- (Rs. Fifteen thousand
only/-) each.
2. Accused shall not tamper the prosecution evidence.
3.
Accused shall produce their identity proof, residential proofs
and mobile numbers of themselves and their two blood
relatives.
