ORDER BELOW APPLICATION FOR RETURN OF PROPERTY
a By this application, the applicant Smt. Manvi Dineshkumar
Gupta is seeking return of property i.e. One Gold Diamond Ring worth of
Rs. 71,000/-, one gold chain of 10 grams worth of Rs. 85,000/-, Pendent of
4 gram worth of Rs. 40,000/-, Golden ring of 4 gram worth of Rs. 30,000/-,
Chain with diamond pendent of 2.69 gram worth of Rs. 60,000/- and
Kaltan Companies Silver Gold plated Watch worth of Rs. 3,000/-, seized in
Crime no. 324/2026 registered with P.S. Chembur. It is contended that the
applicant is owner of the jwellery. On 06.04.2026, she found that above
jwellery is stolen. It was so stolen during 03.04.2026 to 06.04.2026. During
that period two accused persons were sent by Urban Company for
household work. The stolen property is recovered from the custody of
accused. Applicant is seeking interim custody thereof.
2] Called say of 1.0. and APP. They do not have any objection for
grant of application. The 1.0. admitted the recovery of stolen property
from the custody of accused Preeti Burte.
3] I have gone through the application and reply filed thereon. 1
have also gone through the FIR and panchanama annexed to the
application. It would reveal description of the stolen property. It would
match with the description of the recovered property mentioned in the
panchanama, as well as mentioned in the reply of the 1.0. The applicant has
also filed bills of jwellery, However, even the verification is thereof is not
necessary. The ownership of the applicant/informant over the stolen
property is not disputed by anyone, including prosecution and defence. It is
admitted. Since the stolen property is recovered from the custody of the
accused, her say is also called. The accused Preeti Burte appeared and filed
her no objection for grant of application,

The description of the stolen property, as mentioned in the FIR,
application, reply and panchanama is as under.
1. One Gold Diamond Ring worth of Rs. 71,000/-,
2. one golden chain of 10 grams worth of Rs. 85,000/-,
3. Pendent of4 gram worth of Rs. 40,000/-,
4. Golden ring of 4 gram worth of Rs. 30,000/-,
5. Chain with diamond pendent of 2.69 gram worth of Rs. 60,000/- and
6. Kaltan Companies Silver Gold plated Watch worth of Rs. 3,000/-.
5] Thus there is no legal hurdle for return of property to the
original informant ie. the applicant towards interim custody, subject to
certain conditions and on execution of indemnity bond. Hence, I pass
following order.

Application is allowed.
Seized muddemal property i.e.
1. One Gold Diamond Ring worth of Rs. 71,000/-,
2. one golden chain of 10 grams worth of Rs. 85,000/-,
3. Pendent of 4 gram worth of Rs. 40,000/-,
4, Golden ring of 4 gram worth of Rs. 30,000/-,
5. Chain with diamond pendent of 2.69 gram worth of Rs.
60,000/- and
6. Kaltan Companies Silver Gold plated Watch worth of Rs.
3,000/-. be handed over to the applicant Smt. Manvi
Dineshkumar Gupta on executing indemnity bond of
Rs.3,00,000/- towards interim custody, till disposal of the
proceeding.
The applicant shall not change nature of the property, shall not

transfer it and shall produce the same as and when directed.
