ORDER PASSED BELOW BAIL APPLICATION NO.396/BA/2026
IN CASE NO. 604/PW/2026 OF
V. B. NAGAR POLICE STATION, MUMBAI.
1. Heard both the parties. Perused the application and say
filed by the Ld. APP. This is an application filed by the accused to
release him on bail. The offence under Sections 309(6), 352,
351(3) of B.N.S., 2023 is registered against accused. The learned
advocate for the accused has submitted that accused is permanent
resident of Gujarat. Accused has not committed the present offence.
He is falsely implicated in this case. He is ready to abide the
conditions imposed by Court. Hence, he may be released on bail.
2. The Ld. A.P.P. has contested this application by filing
his say. It is contended by the him that the offence is serious in
nature. If accused is released on bail, he may abscond and tamper
the prosecution witnesses. Furthermore, near about 25 offences are
pending against present accused. Hence, he prayed for rejection of
application.
3. The accused is charged under Section 309(6), 352,
351(3) of BNS, 2023. The chargesheet has been filed the present
case. The custody of accused is not required by the police. Hence,
considering the facts and circumstances, nature of the offence, there
is no purpose to keep accused behind bars and he can be released
on furnishing surety. In view of above, following order is passed.
ORDER
1. Accused Hussain @ Ucchi Salim Shaikh be released
on bail on executing P. B. & S. B. of Rs.15,000/- with solvent surety
or like wise cash amount on following conditions.

2. He will comply of provision of Para 12(1) to (6),
Chapter 1 of Criminal Manual.
i) He will submit a list of atleast 3 blood (relatives)
with their detail residential addresses and also the addresses
of their place of work.
ii) He will submit copy of any two document of his
residential proof.
