ORDER PASSED BELOW BAIL APPLICATION NO. 784/BA/2025.
C.R. NO. 421/2025 OF CHUNABHATTI POLICE STATION
The accused Arbaz Siddiqui Shaikh has filed bail application.
The learned advocate for the accused has submitted that, the accused is
falsely implicated in this crime. He is the only earning member of his family.
He is permanent residents of Mumbai. He is ready to abide conditions
imposed by Court. Therefore, prayed to release him on bail.
2. Ld. APP and I.O. have contested this application by filing their
say. It is contended by the Ld. APP that, there is prima facie evidence against
accused. If accused are released on bail then they will misuse their liberty
and it is not just and proper to release the accused at this stage. Hence, he
prayed to reject the applications. It is contended by the I.O. that, if accused is
released on bail, then he may threaten the informant and witnesses and
cause hurt to the informant. The statements of eye witnesses are yet to be
recorded. Accused has committed serious offence. Therefore, detailed
investigation is necessary. Hence, he prayed to reject the application.
3. Heard advocate for accused at length. I have gone through the
say filed by Ld. APP, I.O. and Intervener. Accused is charged under section
308(3), 137(2), 140(3), 115(2), 352 of The Bharatiya Nyaya Sanhita, 2023.
He is ready to furnish surety. So, considering the facts and circumstances
there is no purpose to keep accused behind bar when He is ready to furnish
sureties and abide the conditions. In view of above, I pass following order.
ORDER
1. Accused Arbaz Siddiqui Shaikh be released on bail on executing P. B. &
S. B. of Rs. 20,000/- with one or more solvent sureties or like wise
cash amount.

2. Accused is directed to furnish his address proof.
3. Accused is directed to attend the Chunabhatti Police Station on every
Saturday between 11:00 am to 01:00 pm to co-operate the
investigating agency till filing of chargesheet.
