1. This is summary criminal case pending in this court.
Today accused is absent. He is absent since long. So, this court
issued non-bailable warrant against the accused from time to time.
Case is old one. However, police machinery failed to secure his
presence for trial. Therefore, it would not be proper to keep this
case pending for years together for securing presence of the
accused. Thus, there is necessity to invoke provision under Section
258 of the Cr. P. C. of stopping of proceeding. In the result,
following order.
O R D E R
i) The proceeding is stopped under Section 258 of the
Cr. P. C.
ii) R & P be send to record room.
