COMMON ORDER BELOW BAIL APPLICATION NO. 1330/BA/2024
AND 1331/BA/2024 IN
C.R.No. 504/2024 OF CHEMBUR POLICE STATION.
By this application, accused are seeking their release on
bail. It is contended that accused are permanent residents of
Mumbai. There is no prima facie case made out against accused.
Stolen property is already recovered. Accused are ready to abide by
the conditions whichever imposed by the court. They are only
earning member of their family. They are ready to furnish surety.
They are seeking grant of bail.
2] Called the say of Ld. APP and I. O. They strongly
objected the application.
3] Heard both sides.
4] I have gone through the FIR and remand report. It would
show that applicants/accused are apprehended and stolen property
came to be recovered from their custody. Thus stolen property is
recovered. Therefore, they are not required to be kept behind bar,
especially when they are local residents of Mumbai. Therefore,
accused are entitled to be released on bail on certain conditions.
Hence, I pass following order.
ORDER
i) The accused No.1 Shakir Hussain Shaikh,
accused No.2 Manojkumar Shivnath Saroj

and accused No. 3 Shakir Sajid Shaikh be
released on P. B and S.B. of Rs.15,000/-(Rs.
Fifteen thousand only/-) each.
ii) They shall not tamper the evidence.
iii) They shall produce their identity proof and
residential proof of themselves and two
blood relatives.
