ORDER BELOW EX.1
Read the application. Perused the record. Heard learned
counsel for the applicant.
2. It appears that applicant was accused in
C.C.No.3442/PS/2021, which has been decided by judgment on
28/06/2024 and acquitted. However, due to spell mistake in his name
‘Moyinuddin Asuddin Shaikh’ came to be written instead of ‘Moijuddin
Asduddin Shaikh’. The name of applicant is mentioned ‘Moijuddin
Asduddin Shaikh’ in his Adhar Card and driving license produced on
record. The correction of spell in name of applicant is the clerical
mistake and will not alter or review the judgment. In view of section
362 of Cr.P.C., the correction of clerical or arithmetical error is
permissible. Hence, pass following order.
O R D E R
1. The application stands allowed.
2. The name of applicant / accused be correct ‘ Moyinuddin
Asuddin Shaikh’ as ‘Moijuddin Asduddin Shaikh’ in
judgment of C.C.No.3442/PS/2021 passed on dated 28/06/2024.
3. The miscellaneous application is disposed off accordingly.
