ORDER BELOW APPLICATION FOR RETURN OF PROPERTY
Perused the application and say thereon. Also, heard the
learned advocate for the applicant. The applicant has filed present
application for return of property i.e. autorickshaw bearing registration
No.MH-03-CN-2726 which is in custody of police. The applicant has
filed an affidavit in support of the application as well as produced
documents. Hence, the applicant is entitled for interim custody of said
vehicle. Therefore, I pass the following order.
(1) The application is allowed.
(2) The Senior Police Inspector of R.C.F. Police Station is
directed to handover interim custody of seized vehicle
i.e. autorickshaw bearing registration No.MH-03-CN-
2726 seized in C.R.No.114/2023 to applicant namely
Rambilas Shyamkaran Chaurasiya @ Ram Vilas
Shyamkaran Chorsiya on executing bond of
Rs.1,00,000/- (Rupees One Lac Only) at the Police
Station.
(3) The applicant shall not transfer or change nature of
the said property till final decision of the case.
(4) He shall produce it before Court as and when required
by the Court.
