1. In view of special drive initiated by Hon’ble Bombay High
Court, Mumbai, the present matter is kept for dismissal order today.
2. The matter is of 2019. The complainant has filed present
complaint under Section 138 r/w. Section 141 of The Negotiable
Instrument Act. The complainant and his counsel have failed to take any
steps. On 21.07.2025, order passed below Exh.1, that no steps taken by
the complainant, hence put up the case for dismissal order on next date.
Inspite of calling out the complainant and his Advocate, they are absent
today. Further, inspite of directing the complainant and his counsel to take
steps and proceed with the case, they failed to do so. The absence of
complainant shows that complainant is not interested to proceed with the
case. Hence, no purpose will be served by keeping an unattended matter
on record. Hence, the order :-
ORDER
1. The complaint is dismissed due to the absence of the
complainant vide Section 256 of Criminal Procedure Code,
1973.
2. The accused No.1 is accordingly discharged.
