ORDER BELOW BAIL APPLICATION
Perused the application filed by accused Shahabaj Mohd. Shafi
Momin, say filed by APP and IO. From the perusal of remand papers it
reveals that the present accused is alleged to have committed the
offence u/s. 394, 506 of I.P.C. Heard Adv. for both parties. The offence
is non-bailable however triable by this court. The accused is arrested
and produced before Court on 25/04/2024 and thereafter is remanded
in Magisterial Custody. Thus, in such facts and circumstances of the
case no purpose would be served by keeping present accused behind
bar. Thus, the accused can be released on bail by imposing certain
conditions which will meet the ends of justice. Hence, order.
1. Accused Shahabaj Mohd. Shafi Momin, be released on bail on
executing P.B. and S.B. of Rs.20,000/-with one or more surety in
the like amount or cash surety in like amount for the period of
two weeks. At the time of depositing cash bail, accused is
directed to submit the copy of his/ his relatives address proof i.e.
Aadhar Card, Pan card, ration card, driving license, bank
passbook, passport, voter ID card, mobile numbers etc. on record
which is condition precedent.
2. The accused should not tamper with the prosecution witnesses/
evidence and shall not make any threat, inducement to any
person acquainted with facts of case.

3. The accused should not commit any offence.
4. The accused shall make himself available for interrogation by I.O.
as and when required under a written intimation till filing of
charge-sheet.
5. Breach of any conditions by accused the prosecution is at liberty
to apply for cancellation of bail of accused granted by this order.
