ORDER BELOW EXH-1 IN C.C. NO. 6000234/PW/2019
Perused the record. This court has issued notice to the
informant. The informant submitted pursis and expressed his desire not
to pursue the case. He has no objection to stop the proceedings. A self-
attested copy of the informant's Aadhaar Card has been filed on record,
and the signature on this copy matches that on the F.I.R. and written
pursis. Consequently, the Court is satisfied that the informant does not
wish to continue with the matter.
Considering the submissions of the informant before police
and the existing situation, there is no justification to keep the matter
lingering unnecessarily. Hence, I pass the following order.
ORDER
1. The accused Bharat Arjun Minar and Moiddin Alim Sayyad are
hereby acquitted under section 320(8) of the Code of Criminal
Procedure of the offence punishable under sections 379, 34 of the
Indian Penal Code.
2. The bail bonds of the accused stands canceled.
3. Muddemal property mentioned in the charge sheet i.e. Bajaj
Pulsar Motorcycle bearing no. MH06Q1457 be returned to the
informant Mohammad Farukh @ Aadam Shaikh R/o. G Sector, O
Line, Room No. 08, Chitacamp, Trombay, Mumbai, after appeal
period is over.
