ORDER BELOW EXH. 1
Perused the application, say filed by investigation officer. Applicant prayed
for interim custody of seized Motor Scooter Suzaki Access bearing No. MH03
DJ1156 . On perusal it reveals that the applicant filed affidavit and produced the
relevant papers of said vehicle that he had purchased motorcycle. The vehicle is a
machine and nonuser of it, it becomes idle. So, it is justifiable to give interim
custody to applicant. Hence, Applicant is entitled to its interim custody on certain
conditions. In the result following order :
ORDER
1. Application is allowed.
2. Police Station Officer of Shivaji Nagar Police Station, Mumbai is directed
to handover interim custody of Motor Scooter Suzaki Access bearing No.
MH03DJ1156 seized in crime No. 29/2022 to applicant.
3. Applicant is directed to furnish supurtnama of Rs. 15,000/ and before I.O.
4. Applicant is directed not to alienate or change the nature of above said
vehicle till disposal of the case.
5. I.O. is directed to take photographs of the vehicle at the costs of the
Applicant. He is further directed to prepare detail panchanama of the
vehicle and furnish it along with report.
6. Inform accordingly.
