CRIME NO. 749/2025 OF V. B. NAGAR POLICE STATION,
MUMBAI.
1. Heard both the parties. Perused the application and say
filed by the Ld. APP. This is an application filed by the accused to
release him on bail. The offence under Section 305 of B.N.S., 2023
is registered against accused. The learned advocate for the accused
has submitted that, accused is permanent resident of Mumbai.
Accused has not committed the present offence. He is falsely
implicated in this case. He is ready to abide the conditions imposed
by Court. Hence, he may be released on bail.
2. The Ld. APP has contested this application by filing his
say. It is contended by the him that, the offence is serious in nature.
If accused is released on bail, he may abscond and tamper the
prosecution witnesses. Hence, he prayed for rejection of application.
3. The accused is charged under Section 305 of B.N.S.,
2023. The charge-sheet has been filed in the present crime. So,
considering the facts and circumstances, nature of the offence, there
is no purpose to keep accused behind bars and he can be released
on furnishing surety. In view of above, following order is passed.
ORDER
1. Accused Hasib Mohd. Akhtar Khan be released on bail on executing
P. B. & S. B. of Rs.30,000/- with solvent surety or like wise cash
amount on following conditions.
i) He shall comply of provision of Para 12(1) to (6), Chapter 1
of Criminal Manual.

ii) He shall submit a list of atleast 3 blood (relatives) with their
detail residential addresses and also the addresses of their place
of work.
iii)He shall submit copy of any two document of his residential
proof.
