ORDER BELOW BAIL APPLICATION NO. 25/BA/2026
1) Read the application and say. Heard Ld. Advocate for the
accused and Ld. APP. The Ld. Counsel of accused submitted that, on last date
the accused were absent therefore, the order of N.B.W. and forfeiture of bail
bond has been passed against the accused. The accused are ready to attend
the court on each and every day. Hence, prayed for bail.
2) Ld. A.P.P. resisted the present application on the grounds that
offence is serious in nature. The accused may abscond and delay the trial.
Thus, prayed for rejection of bail application.
3) Perused the remand papers and charge-sheet. It appears that, on
01.10.2025 accused and their counsel were absent. The witness was present
therefore, the order of N.B.W. and forfeiture of bail bond has been passed
against the accused. No any reason is mentioned in the application as to why
accused remained absent. But, the accused are ready to attend the court on
each and every date. Hence, in the interest of justice only one more
opportunity is required to be given to the accused. Hence, I pass the following
order :-
ORDER
(1) The application is allowed.
(2) The accused be released on furnishing P.B. and S.B. of Rs. 50,000/-
(Rs. Fifty Thousand Only) each or cash bail of Rs.10,000/- each
with P. R. bond of Rs.50,000/- each alongwith amount of bail bond
forfeited to the government in Crime No.252/2018 for the offence
punishable under Section 326, 504 r.w.s. 34 of the Indian Penal
Code.
(3) Bail Application is disposed off accordingly.
