The accused is convicted of the offence punishable under section 138 of the Negotiable Instruments Act, 1881 vide Section 255(2) of the Code of Criminal Procedure, 1973 and accused No.2 sentenced to suffer simple imprisonment for six months.
The Accused shall pay the complainant a compensation of Rs.1,19,394/- (One Lakh Nineteen Thousand Three Hundred Ninety Four only) along with 9 percent simple interest per annum from the date of filing of complaint till actual realization thereof vide section 357(3) of the Code of Criminal Procedure 1973 and in default, accused No.2 shall undergo simple imprisonment for three months.
