ORDER BELOW EXH1
This is a summary case filed against accused for an offence
punishable u/sec. 138 of Negotiable Instruments Act. I have gone
through the record and proceedings. Order of issue process is passed.
The complainant is continuously absent since long. No steps taken to
proceed further in this case. The case kept for dismissal order. Today
case is kept in special drive. However, none appeared on behalf of
complainant. This case is pending since the year 2017. However, no
effective steps taken to proceed further in this case. It goes to show
that, the complainant is not interested to proceed in this case. No
purpose would serve to keep the case pending on daily board. The
complaint is liable to be dismissed under section 256 Code of Criminal
Procedure. Hence, I proceed to pass following order:
ORDER
1) The case is dismissed under Section
256 of Criminal Procedure Code.
2) The accused stands acquitted of the offence
p/u/s. 138 of Negotiable Instruments Act.
3) Bail bonds of accused if any stands
cancelled.
