Order below Application for return of property filed by the
applicant Javed Jamil Inamdar
1 Perused the application, say of IO. No say filed by the
learned APP. Investigation officer has submitted that the property
mentioned in the application was not recovered from the possession of
the accused. The accused has been arrested only on the ground that he
was captured on CCTV footage. Due to arrest of the accused the
applicant is filed this application for return of property.
2 I have gone through case papers. The property
mentioned in the application is not seized by Investigating officer from
the place of incident. There is nothing on record to show that the
property mentioned in the application was the property of applicant.
Hence, at this stage, applicant is not entitled to the seized property as
claimed in the application. Hence, following order
ORDER
Application is rejected .
