ORDER BELOW EXH.1
1] This is an application moved by the applicant API Shri. Abhijit Kale,
Malad Police Station Police Station Mumbai for undertaking the exercise of
certification of drawing of samples under NDPS Act in respect of seized
contraband of which the details given in the application.
2] As per the office order of Chief Metropolitan Magistrate, Esplanade,
Mumbai dated 11/10/2017 bearing no. EStt/16/1450-2017 with reference to
Criminal Writ petition no. 929/2013 Union of India vs the Registrar and office
order no. Estt/16/1294/16 dtd. 06.09.2016, the undersigned (JMFC 64th Court)
is notified under section 52-A(2) of the aforesaid Act to deal with applications
of like nature. In the light of the provisions contained in section 52-A(2) of the
Narcotics Drugs and Psychotropic Substances Act, 1985, applicant I.O. of Malad
Police Station Police Station Mumbai, has inter alia prayed for certification of
correctness of inventory and issuance of such certificate; to permit taking in
presence of the court of the seized items, inventory and to draw and certify the
correctness of samples so drawn.
3] In view of the provisions contained in Section 52A of NDPS Act, 1985, the
I.O. was directed to undertake the exercise prayed for today at about 16.15 hrs.
in my presence as provided by law.
4] IO has submitted inventory in Form-4 and application in Form-5,
therefore, certificates are issued. Accordingly, the application is disposed of in
terms of carrying out the inventory and issuance of certificate
