ORDER BELOW APPLICATION FOR PERMISSION TO
TRAVEL ABROAD AND RETURN OF PASSPORT FILED IN CASE
NO.721/PW/2019
(Mrs. Ruchita Dhruv Patel Vs. EOW, Mumbai)
Present application has been filed by Mrs. Ruchita
Dhruv Patel, who is an accused in C.C.No.721/PW/2019. By this
application, the accused seeks permission to travel abroad i.e.
China, Hongkong City for the period of one month from
05.07.2026 to 04.08.2026 along with return of passport. Hence,
this application.
2. Learned APP for the State and I.O. opposed the
application contending that offences levelled against the accused
are serious. There is possibility of her absconding. They prayed for
rejection of application.
3. Heard both sides.
4. As mentioned above, applicant wants to go to abroad
i.e. China, Hongkong City for the period of one month from
05.07.2026 to 04.08.2026 for business purpose. The present
matter is pending for framing of charge. She has filed an affidavit
stating therein that no other Court/Authority restricted her from

travelling beyond India. Considering the reasons, I do not find any
hurdle to grant her request to go to abroad. Hence, the following
order.
ORDER
1. Application is allowed.
2. Applicant Mrs. Ruchita Dhruv Patel is permitted to go to abroad
i.e. China, Hongkong City for the period of one month from
05.07.2026 to 04.08.2026 on following conditions,
i) Applicant shall give affidavit as to her place of residence
and contact numbers during her stay abroad to the Court
as well as to the concerned Unit of EOW.
ii)She shall give copy of her Visa and Passport to the Court
as well as to Sr. PI of the Concerned Unit of EOW .
iii)She shall inform to the concerned Unit of EOW before
her departure and after her arrival.
iv) In addition to the surety given by her she shall give the
cash security of Rs.1,00,000/-(Rs.One Lakh Only) in the
Court. If any amount is already deposited by her after
decision of previous application of same kind, then that be
adjusted in compliance of this order.
v)She shall not dispute her identity in the trial before
Court during her absence from India.
vi)She is also directed to furnish contact numbers of her
two close relatives in India and provide proof of her
permanent resident.

vii)She shall make necessary arrangements to proceed with
the matter through her advocate within the said period
and she shall not hinder matter/proceedings during her
stay abroad.
viii) The applicant shall submit her detailed itinerary to the
Court as well as to the Investigating officer.
ix) Investigating Officer shall return passport to the
applicant for visa purpose and for travelling period only.
x) Applicant is directed to deposit passport with the
Investigating Officer within one week after her return back
to India.
xi) The permission of travel abroad will be liable to be
canceled at any time if her personal attendance will be
required for the trial or any other purpose.
xii)Applicant/accused shall take permission of the
Concerned Courts in relation to any other matters which
are pending against her, if it is required.
