ORDER BELOW APPLICATION FOR PERMISSION TO TRAVEL
ABROAD FILED IN C.R. No.40/2007 (C.C.No. 1083/PW/2007)
(Salim Lala Shaikh Vs. Economic Offences Wing, Mumbai)
Present application is placed on record by Salim Lala
Shaikh, who is an accused in C.C.No. 1083/PW/2007. By filing
this application, accused prayed to allow him to go to Dubai for
the purpose of Eduteck Education academay business conference
with his colleagues from 03.09.2025 to 09.09.2025. Accused is
facing trial for the offences punishable under Sections 419, 420,
465, 467, 468, 471 and 120(B) of the Indian Penal Code. He is
released on bail on 01.08.2007 by order of this Court. The present
matter is for hearing stage. He prayed for grant of permission to go
abroad.
2. Learned APP for the State and Investigating officer
opposed the application contending that offences leveled against
the accused are serious. Accused may tamper with the evidence of
prosecution. There is possibility of his absconding. They prayed for
rejection of application.
3. Heard both sides.
4. As mentioned above, applicant wants to go to Dubai
from 03.09.2025 to 09.09.2025. It is also informed that he is going
there for business conference purpose. The present matter is at
hearing stage. He has also filed an affidavit stating therein that he
has been not restricted to travel abroad from any other Court.

There is no any criminal proceedings pending or registered against
him apart from this case. It appears that the accused had earlier
sought similar liberty from this Court in this crime by filing case
No.171/Misc/2025. My learned Predecessor had granted the said
application and had permitted this accused to travel abroad. The
present application is in the similar line and this Court does not
find any cogent reason to restrain this accused. Hence, the
following order.
ORDER
1. Application is allowed.
2. Applicant Salim Lala Shaikh is permitted to go to Dubai from
03.09.2025 to 09.09.2025 on following conditions,
i) Applicant shall give affidavit as to his place of residence
and contact numbers during his stay in abroad to the Court
as well as to the concerned Unit of EOW.
ii) He shall give copy of his Visa and Passport to the Court
as well as to Sr. PI of the Concerned Unit of EOW.
iii)He shall inform to the concerned Unit of EOW before
his departure and after his arrival.
iv) In addition to the surety given by him he shall give the
cash security of Rs.1,00,000/-(Rs. One Lakh Only) in the
Court. If any amount is already deposited by him after
decision of previous application of same kind, then that be
adjusted in compliance of this order.
v) He shall not dispute his identity in the trial before Court
during his absence from India.

vi) He is also directed to furnish contact numbers of his
two close relatives in India and provide proof of his
permanent resident.
vii) He shall make necessary arrangements to proceed with
the matter through his advocate within the said period and
he shall not hinder matter/proceedings during his stay in
abroad.
viii) The applicant shall submit his detailed itinerary to the
Court as well as to the Investigation officer.
