Examination-in-chief by Ld. A.P.P. Smt. P. S. Patil for the State :-
1. I was posted at EOW Mumbai from March, 2019 to
August, 2022. On 20/08/2019, the investigation in CR No.
77/2018 with EOW was transferred to me from PI Daingade. The
said report was lodged by Gautam Budhrani. I found the name of
accused Amol @ Avikumar Dhule as per the available documents.
Accused Amol Dhule had filed anticipatory bail application before
Hon’ble Supreme Court and it was rejected with directions to him
to surrender within one month. It is alleged by the informant that
he has land at village Vahal and he was in search of an agent to
convert the land for non agricultural purposes. Accused was to
complete this process and informant was going to give him the
price of Rs. 20 crore. Accused had handed over 11 documents to
informant, which included some letters and three forged
documents. These forged documents included order dated
28/10/2015 in RTS appeal No. 245/15, opinion given by Deputy
Forest Conservator Alibag and NOC of Divisional Engineer, Central
Railways.
2. Crime was registered for the offences punishable under
Section 466, 467, 468, 471, 472, 473 and 420 of Indian Penal
Code. On 20/08/2019, accused Amol surrender before this Court

and I filed application for his remand. He was thereafter arrested
in this matter on 20/08/2019 as per the remand granted by the
Court. The arrest was completed by filling the arrest form. Now I
am shown page no. 1263 to 1266 of file no.3. This is the same
form by which I arrested accused Amol. Hence, this arrest form is
given Exh. 234. The contents therein are true and correct. It bears
my as well as the signature of accused Amol. It bears photo of
accused and signature of panch witnesses.
3. I went through all the documents in this crime. I took
prior permission of my senior officer to further investigate as the
documents related to the office of District Collector, Raigad Alibag.
I went there and gave a letter to Deputy Collector on 03/10/2019
having outward No. 2022. I had given this letter requesting to give
all the documents given by accused Amol for getting the non-
agricultural permission for this land. I also gave another letter
bearing outward no. 2032 to Additional Collector on the same day
requesting the verification of the copy of order in RTS Appeal No.
245/15 dated 28/10/2015.
4. Thereafter I went to the office of Deputy Conservator
of Forest at Alibag. I gave a letter bearing outward no. 2025/2019
to the said office for verification of the opinion given by accused
Amol purporting to be of that office. This letter is at Exh. 139. The
said office gave a reply to our office on 23/10/2019. This reply is
at Exh. 43. The concerned office informed that it has not issued
any such opinion as per the said forged document. It was also
informed that this opinion is forged. It was also informed that the
number by which opinion was given, contained a very different

letter in their record. This record is at Exh. 141.
5. I found that there is necessity to conduct a search of
the house of accused Amol for further investigation. Hence, I took
permission from by Senior Officer and went to Mahad to search
the residence of accused Amol. I called two panch and conducted a
panchanama in their presence. Now I am shown the panchnama at
Exh. 200. It is the same. It bears my as well as the signatures of
panch witnesses. I thereafter went to Mahad City Police Station
and Mahad Taluka Police Station. I found that there are five
criminal cases of cheating registered against accused Amol with
Mahad City Police Station. I found that there are three criminal
cases of cheating, forgery and under Arms Act registered against
accused Amol with Mahad Taluka Police Station.
6. I took the original forged documents which were in the
custody of informant by way of document hand over panchnama.
Now I am shown the said panchnama along with documents at
page No. 410 to 574. I took the colour xerox of the true copy of
the order dated 28.10.2015 in RTS Appeal No. 245 of 2015 given
by accused Amol to informant. This copy is at Exh. 40. I also took
the order with forged signature of Additional Collector dated
28/10/2015 in RTS Appeal No. 245 of 2015. As per this order
submitted by accused Amol, the RTS Appeal No. 245 of 2015 was
allowed on 28/10/2015. This order is forged. This order at Exh. 39
and 40 contains date “28” in hand written form.
7. I investigated the round seal on each page of Exh. 40
and the true copy stamp on the last page of Exh. 40. I found that
this round seal and the stamp was of record office of the said

Collector Office. The copy at Exh. 39 only bears round seal on each
page. This round seal also is of record office of the Collector Office.
The documents at Exh. 39 and 40 bear the signature of informant,
panch and mine on the last page. The panchnama of hand over
was conducted on 12/10/2019. It bears my signature, that of
panch and informant. The contains there in are true and correct.
Hence, it is given Exh.235. The third document is the copy of
Power of Attorney given by Sayyed Quadri to informant. The
fourth document is the agreement between Sayyed Qaudri and
informant about the land. The fifth document is the TDS certificate
form 16A issued by informant to the accused for the amount paid
by him to the accused. The certificate is of Rs. 2,50,000/-.
Examination in chief is deferred till next date.
