Examination-in-chief by Ld. A.P.P. Smt. P. S. Patil for the State :-
1. I was called by the concerned Police Officer of Randher
Police Station for the purpose of panchanama. A person named
Agarwal was there. He was checked and searched in my presence
and my signature was taken. Now I am shown the copy of
panchanama at page No.234. It bears my signature. The contents
therein are true and correct. (Learned APP requested to give
exhibit to this document. She submitted that the original papers
are not available and such report is filed by the concerned Police
Station. So this document be exhibited by way of secondary
evidence. Learned Advocate for accused took strong objection
and submitted that it is not original panchanama and hence, it
cannot be exhibited. It appears from the record that the concerned
Police Station has filed a report whereby it is informed that the
original documents are not traceable. So far it is for the
prosecution to take steps if the original record is not made
available by the Investigating Authority and in this case by
Randher Police Station. Mere that statement without further steps
and clarifications cannot be a ground for this Court to admit this
document in evidence).
