Examination-in-chief by Ld. A.P.P. Smt. P. S. Patil for the State :-
1. On 19.10.2003, I was called in Randher Police Station
in relation to one panchanama. The concerned Officer of the
Police Station informed that he is going to prepare a panchanama
about taking specimen signature of Sanjay Hariram Agarwal from
Home Trade company. The concerned Officer prepared a
panchanama in relation to cheques and contract notes issued by
accused Sanjay. The Police Officer prepared panchanama in my
presence in relation to the seizure of documents and taking
handwriting specimen. Now I am shown the panchanama filed in
this matter. I was informed about the contents in the panchanama
and my signature was taken at Sr. No.2. It bears my signature and
contents therein are true and correct. The panchanama
accompanies the documents seized by the Police Officer. Hence,
the panchanama is given Exhibit-87.

Cross examination by Adv. Shital Turakhia for accused No.1 :-
2. I used to drive Auto Rickshaw in year 2003. I was
residing at the same place. I have studied upto 3rd standard. The
concerned Officers from Randher Police station used to call me for
some times in relation to such cases as panch witness. It is true to
say that I just signed on the panchanama and I do not know the

exact content. I do not know who is Sanjay Agarwal. I do not
know anything about these documents, contract notes and
cheques. It is not true to say that I am deposing falsely that I was
called by the concerned Police Officer and I signed as a panch
witness. It is not true to say that I am deposing falsely that the
documents were seized in my presence and the specimens were
taken in my presence. I do not know anything about the crime
and the names of accused.
