Perused the application, grounds mentioned in it and
documents on record. Heard learned Advocate of applicant. It cannot
be forgotten that the application is for condonation of delay. Already
more than sufficient time is expired for consideration of the
application, which will again consume a lot of time. Notice was issued
to other side, however, it has not been served. Considering the
grounds mentioned in the application as well as to decide the real
controversy between the parties on merit and to give fair opportunity
of hearing, I find it proper to condone the delay of 3 days, at the same
time, considering the negligence on the part of complainant, Rs.500/
will suffice the purpose. The application is allowed accordingly, the
complainant to pay the cost Rs.500/ in the account of DLSA, Mumbai
on or before next date. After depositing cost, matter be registered
accordingly.
