No.667/PW/2009 Sudhakar Lakshminarayanan Gande …. Applicant /Accused Vs. CBI, BS & FC .... Respondent ORDER BELOW THE APPLICATION FOR PERMISSION TO TRAVEL ABROAD 1. This is an application by accused Sudhakar Lakshminarayanan Gande for seeking permission to travel abroad i.e. to France from 4th April 2018 to 9th April 2018, for business purpose. 2. The applicant/accused Sudhakar Gande submitted that he is working as a Consultant with M/s. Hindustan Infrastructure Project & Engineering Pvt. Ltd. which is a part of Jupiter Group, Bangalore. He further submitted that earlier also his applications seeking permission to travel abroad were allowed. 2] On the day of filing of this application itself, say of CBI, ACB, Mumbai, was called. However, till today no say is filed by the Department or by Ld. P. P. on behalf of CBI. 4. Heard Ld. Advocate for applicant/accused and perused the record. 5. The applicant/accused has previously travelled abroad on many occasions and has returned back accordingly. It is settled principle of law that pending trial against accused could not take away his liberty to travel abroad. Therefore, considering settled principle of law, I proceed -- 1 of 2 -- to pass following order. ORDER 1) This application No.836/MISC/2018 is hereby allowed. 2) Applicant/accused Sudhakar Lakshminarayanan Gande is permitted to travel abroad i.e. to France from 4th April 2018 to 9th April 2018, for business purpose subject to following terms and conditions :- 3) The applicant/accused shall furnish deposit of Rs.6,00,000/- (Rs. Six Lakhs only) towards security. If, the cash deposit is already deposited in the Court vide earlier orders, it may be continued. 4) The applicant/accused shall inform his detail addresses, telephone/contact numbers including cellphone, in detail itinerary to the Investigating Officer. 5) The applicant/accused shall not seek any extension of time from abroad on any count. 6) He shall intimate his departure and arrival in India to the Investigating Officer. 7) In case the applicant/accused commit breach of any condition, the cash security amount shall be forfeited to the State and non- bailable warrant will be issued against him. 8) The applicant/accused is further directed to file an undertaking that he will not have any objection, if any order is passed against him in the proceeding pending before this court if he or his advocate remains absent on the date of hearing and not filed proper application according to law, during the said period of travel. 9) The applicant/accused shall not dispute his identity during the course of trial. 10) As and when required by this Court, the accused shall remain present before this Court.
