ORDER BELOW EXH.01
The applicant has made an application for grant of no
objection for renewal of passport.
2. It is the contention of the applicant that he is holding
passport bearing No. Z-2332514 and it is expired on 09.02.2022,
therefore, he wants to renew his passport. Hence, he prays for grant of
no objection for renewal of passport.
3. The prosecution has taken objection on the ground that the
present offence is registered and pending against the applicant/accused.
The presence of the applicant/accused is necessary during the trial. if
no objection granted to the applicant for renewal of passport he may
flee away.
4. It appears from the record that charge-sheet is already
filed. Moreover, the right to travel abroad is right of the citizen of
India. Otherwise, also the applicant/accused has to obtain permission
from this court while travelling abroad. So considering the facts and
circumstances, I proceed to pass the following order :
ORDER
1) Issue No-Objection letter to the passport authority to renew
passport of the applicant for next ten years.
2) The applicant/accused shall not leave this country without prior
permission of this Court.
3) The record be kept with original case.
