Heard adv for applicant and adv for plff. on Ch/s.  The Ch/s is taken out by the. applicant for impleading respondent as a party deft no.3 and carryout amendment accordingly.  The Ch/s is apposed by filing reply by the plff. on itself.  The suit is filed for declaration and perpetual injunction as to not to construct the suit building unauthorizedly.  According to applicant/proposed deft no.3, the suit premises is belongs to the applicant.  Applicant has been in use occupation of the suit premises any order passed by this court will affect right of the applicant.  Hence, the applicant is necessary and proper party and he may be implemented as a party defendant in the suit.  The adv for the applicant admits that the suit property is in possession of the applicant/proposed deft no.3.  On going through the Ch/s schedule of amendment in the light of plaint along with document available on record.  It is seen that the applicant is necessary and proper party.  It is necessary for the purpose of determining the real question in controversy between the parties to implead the applicant in the suit.  In order to avoid further litigation and loss inconvenient to the plaintiff, it is necessary to allow the Ch/s.  Hence, following order is passed-
						ORDER-
1.	Chamber Summons No.1437 of 2022 is hereby allowed.
2.	The plaintiff is directed to implead the applicant as a party 	defendant and carryout amendment and consequential amendment  	within 14.
 3.	After carrying out amendment, the plaintiff shall provide copy of 	amended plaint to the proposed defendant and court.
4.		Chamber Summons No.1437 of 2022 is disposed off accordingly.
