Perused the notice of motion. Heard both the sides. The Ld. Advocate for defendant submits that there was settlement talks between plaintiff. Therefore, due to positive discussion the written statement was not filed within 30 days, and there is delay of 65 days. The other side objected to condone the delay by filing say on the ground that the reason for delay is not proper. It appears that after 30 days the delay of 65 days is caused to the defendant in submitting written statement. The said written statement is within 120 days therefore, discretion can be used to allow the notice of motion. In view of reason set out in the notice of motion that there was positive talks for settlement, the opportunity to defend the suit on merit is to be given to the defendant. The inconvenience caused to the plaintiff due to delay can be compensated. Hence, notice of motion is allowed subject to cost of Rs.2500/- to be paid to the plaintiff. On payment of cost the written statement be exhibited. Accordingly notice of motion no. 2006/2024 stand disposed off.
